FinCEN has made permanent an exemption that removes U.S.-formed companies, including aircraft ownership LLCs, from beneficial-ownership reporting under the Corporate Transparency Act. The final rule took effect on 14 August and also orders the deletion of previously reported information linked to U.S. persons from the database.
The change eases compliance for business aviation structures that commonly rely on limited liability companies to hold aircraft. U.S.-based owners and operators no longer have to file beneficial ownership information for domestic entities, reducing an administrative burden that had applied under the earlier reporting regime.
Foreign entities registered to do business in the United States remain within the reporting net, but only for non-U.S. beneficial owners. Treasury’s move follows an interim rollback issued earlier and now makes the exemption permanent, extending relief across domestic aviation ownership structures while preserving reporting requirements for foreign companies with U.S. registration.
