The FAA has withdrawn a proposed $15.7 million civil penalty against Aery Aviation, ending an enforcement case that alleged 431 flights were operated with unairworthy aircraft. The withdrawal followed a September 14 letter from the FAA’s Aviation Litigation Division to the Newport News, Virginia-based business aviation operator.
The agency said it was not in the interest of justice to continue after full review of the case and evidence. The original penalty notice was issued in December 2025 and covered flights the FAA said occurred between July 2021 and April 2022.
The proposed penalty was among the largest ever sought against a non-airline operator, making the reversal notable for business aviation. Aery had contested the case, which centred on maintenance and airworthiness issues tied to its operations.
