Argentina will ask the US Court of Appeals for the District of Columbia Circuit to reconsider its ruling upholding a $390.9 million judgment linked to the expropriation of Aerolíneas Argentinas and Austral, according to reporting published on Wednesday. The filing is due by Thursday and is intended to keep the dispute alive at the appeals-court level while Buenos Aires avoids moving immediately to the US Supreme Court.
The case stems from a 2017 CIADI arbitration award in favour of Titan Consortium and later enforcement proceedings in the United States. The appeals court ruled on 21 July that Titan’s claim was timely, allowing enforcement of the award plus accrued interest. Argentina is not seeking a stay of enforcement at this stage, leaving Titan free to continue efforts to pursue Argentine assets in the United States.
The planned request would ask the same court to review its own decision rather than challenge the matter directly before the Supreme Court. The dispute relates to the 2008 expropriation of the two airlines, which remains one of Argentina’s most significant aviation-related legal liabilities.
