Argentina has asked a Washington appeals court to reconsider a ruling that lets Titan Consortium pursue enforcement of a judgment worth about $390.9 million, plus interest, over the 2008 expropriation of Aerolíneas Argentinas and Austral. The move extends a long-running dispute rooted in the nationalisation of the flag carrier and keeps open the risk of collection efforts against Argentine sovereign assets abroad.
The legal fight stems from an arbitral award issued in 2017, which originally valued the claim at about $321 million plus costs and interest. Titan Consortium inherited the claim after Burford Capital and is now pressing ahead in Washington, where Argentina has already lost on its statute-of-limitations argument. Argentine lawyers want the appeals court to revisit that decision before any further step toward the US Supreme Court.
The practical focus is no longer the airline itself, which is treated as a separate company, but the state’s exposure in the United States and other jurisdictions. The amount is reported as roughly $390 million or $391 million, reflecting rounding of the same award-plus-interest figure.
